Federal Court Rejects Tenant’s COVID-19 Lease Defenses

A decision from the Southern District of New York has come down squarely on the side of commercial landlords concerning the enforceability of commercial leases in light of COVID-19. The Court rejected all of tenant’s COVID-related defenses, including frustration of purpose, impossibility of performance, and casualty.
