On May 28, 2020, the New York State Department of Health published the Interim Guidance for Commercial Building Management during the COVID-19 Public Health Emergency. The guidance sets forth the minimum requirements that owners and managers of non-residential/commercial buildings must implement as such buildings reopen and/or continue to operate during the COVID-19 public health emergency. This memorandum focuses on the provisions of the guidance that apply to the responsibilities of landlords or building owners to their tenants.
