President Biden Announces Heightened Focus on Prosecuting Pandemic-Related Fraud

On March 1, 2022, President Biden used his State of the Union address to announce a renewed focus on preventing, deterring, and punishing pandemic fraud. Specifically, he explained that the Department of Justice COVID-19 Fraud Enforcement Task Force will expand its efforts by appointing a Chief Prosecutor to lead specialized teams, which will investigate criminal fraud in pandemic-relief programs such as the Paycheck Protection Program (PPP). Although the Department of Justice (DOJ) has prioritized developing criminal and civil cases against individuals and companies for PPP fraud since the administration’s early days, President Biden’s emphasis of the issue, and call for heightened resources and enhanced penalties, suggests heightened scrutiny of PPP participants.
