COVID-19 Client Alert: N.Y.C. Council Int. No. 1932-A (2020) and N.Y.C. Council Int. No. 1914-A (2020) Enacted to Protect COVID-19 Impacted Tenants

On May 26, 2020, Mayor De Blasio signed into effect legislation that temporarily prohibits the enforcement of personal liability provisions in commercial leases or rental agreements involving a COVID-19 impacted tenant and prohibits certain acts of harassment against such parties. The legislation applies to specified retail businesses that were ordered to shut-down operations due to COVID and individuals who suffered health or economic hardship due to COVID. We anticipate the state and federal constitutionality of the legislation to be challenged.
