ABA: Merger Remedies: Can we get this right?

Bernard (Barry) A. Nigro Jr., partner and chair of the Firm's Global Antitrust and Competition Department, will speak on the American Bar Association Antitrust Law Section’s panel titled “Merger Remedies: Can we get this right?”  The program will be moderated by Jesús M. Alvarado-Rivera, Global Director for Antitrust at Anheuser-Busch InBev, and is sponsored by the ABA’s Mergers & Acquisitions Committee and the Federal Civil Enforcement Committee.  As you know, the DOJ and FTC have expressed disappointment with their merger enforcement record.  AAG Kanter stated that “in most situations [DOJ] should seek a simple injunction to block the transaction,” showing a high willingness to litigate. The panelists will discuss: Does our merger remedies’ policy need fixing? What should we learn from previous matters? Can we build an effective and predictable policy? What will the agencies do now?
