Fried Frank Obtains Victory for Westbrook Partners

  

On Tuesday, March 27, 2018, Fried Frank obtained an important victory for Westbrook Partners, LLC, The Leading Hotels of the World, Ltd. (LHW) and Highgate Hotels LP, successfully opposing a motion for a temporary restraining order brought by the Residents of Millennium Point, a Ritz-Carlton managed condominium at 10 West Street (in the same building as the soon-to-be formerly known as Ritz-Carlton Battery Park hotel). The motion was filed in the New York State Supreme Court by the Residents seeking to halt the transition of the hotel's operator and brand from Ritz-Carlton to Highgate and LHW, which was scheduled to take place less than 48 hours later. Justice Eileen Bransten agreed with Westbrook's arguments that the Residents, who had known of the impending change for months, both waited too long to bring their TRO motion and that their claims were premature, as they could not demonstrate that Highgate and LHW would not operate the hotel, soon-to-be known as the Wagner at the Battery, in the luxury manner required by the governing document, the ground lease with Battery Park City Authority.
