James J. McCullough speaks with Law360 about US Supreme Court's review of state secrets privilege in government contracts litigation

Washington, DC litigation partner James McCullough was quoted in a Law360 article, "Supreme Court To Weigh State Secrets In A-12 Case," on the US Supreme Court’s review of an ongoing dispute between the government and Boeing and General Dynamics regarding a canceled contract for a military aircraft.  The matter, also known as the A-12 case, brings into question the issue of the state secrets privilege, which allows the government to end litigation on the grounds that certain evidence, if disclosed, would harm national security interests.  Mr. McCullough commented, “Although we haven’t seen a frequent invocation of the state secrets privilege in government contract litigation in the past, because of increased use of contracts in this sphere, we’re potentially going to see that happen more and more in the future.”
