In response to the SEC's recent approval to amend the Form ADV Part II, corporate partner Terrance O'Malley says in February 15, 2008 Absolute Return: Hedge Fund Intelligence article, "SEC Proposes Increased Disclosure for Registered Hedge Funds," that "hedge fund managers hoping to avoid providing additional disclosure may argue against the need to provide the adviser brochure (Form ADV Part II) to investors at all, using the Goldstein case as a precedent."  In the June 2006 ruling in the Goldstein case, the court overturned a newly implemented rule that had required hedge funds to register with the SEC.
