Fried Frank provides counseling, compliance and enforcement advice on all aspects of US Customs rules and regulations. Overseen by US Customs and Border Protection (CBP) within the US Department of Homeland Security, Customs law lies at the intersection of international trade and national security.  Importers and exporters are focused on ensuring the safe and timely transport of goods across the border, while minimizing duty liability where possible. The US Government is concerned with the security of our nation's borders and corporate supply chains.

Our lawyers are experienced in Customs compliance issues, including tariff classifications, valuation, country-of-origin regulations, marking, import bonds and foreign trade zones, and NAFTA-related Customs provisions. We assist clients to prepare requests for Customs rulings, Customs protests of wrongful liquidations or other decisions, and prior disclosures of potential Customs violations. In relation to our export control practice, we advise importers and exporters on the Customs clearance aspects of transactions controlled under the ITAR and EAR. Our Customs expertise also includes representing clients in enforcement matters, including preparation of penalty petitions.

In conjunction with our national security practice, Fried Frank lawyers also counsel clients regarding the Customs-Trade Partnership Against Terrorism (C-TPAT) program, including assisting importers to craft compliance plans that are appropriate for their operations.
