Deploying State Unfair and Deceptive Acts and Practices Statutes in Business-to-Business Litigation

American Bar Association Section of Antitrust Law and State Enforcement

Antitrust and competition associate George L. Wolfe will moderate the panel “Deploying State Unfair and Deceptive Acts and Practices Statutes in Business-to-Business Litigation,” hosted by the American Bar Association Section of Antitrust Law and State Enforcement. The panel will consist of leading former state attorneys general and private practitioners who will discuss the intricacies of using state Unfair and Deceptive Acts and Practices statutes in business-to-business litigation.

The discussion will also showcase how these state statutes diverge from Section 5 of the FTC act, and how private litigation under these statutes materially differs from claims brought by government enforcement agencies, including how a business can establish sufficient harm or injury to establish a claim.
