IP Technology Transactions attorneys Jason L. Greenberg and Daniel E. Stern will join IP Litigation attorneys Robert M. Masters and Timothy P. Cremen to host an IP Quarterly Call on Tuesday, May 1, 2018 at 1:00 p.m. It will cover:
- An update on recent developments in the law of patent eligibility under § 101, including Federal Circuit decisions that make it more difficult to win a motion to dismiss at the pleading stage;
- A review of the PTAB's decision in Mylan v. St. Regis Mohawk Tribe, which declined to recognize tribal sovereign immunity in IPRs and held that IPRs may proceed against an exclusive licensee without the participation of the patent owner; and
- A recap of recent Federal Circuit cases addressing the on-sale bar under §102(b) in the context of manufacturing and distribution agreements.
